Additional comments: 51% of capital owners must be pharmacists, and 26% of these capital owners must have pharmacist activities in Morocco; however foreign pharamacists have to submit an agreement which depends on the localisation, Dahir (law) n 1.59.367 (February 19th 1960).

The manufacture, import, export and wholesale of drugs can be made by the pharmaceutical establishments and industrial establishments and pharmaceutical wholesalers. The pharmaceutical industry establishment is an establishment with a manufacturing site and performing the operations of manufacture, import, export and wholesale of medicines and, where appropriate, wholesale distribution. Establishing pharmaceutical wholesale distributor is any institution performing activities related to the purchase, possession and distribution of wholesale drugs to pharmacies and drug reserves in clinics. (Art 19 Art 74 of Law 17-04 on the code of the medicine and pharmacy)The manufacture of any drug should be made in compliance standards of good manufacturing practices and distribution imposed by administration after consultation with the National Council of the College of Pharmacists. (s. 20) Any proposal to establish a pharmaceutical company is granted subject to prior authorization granted by the administration after consulting the National Council of the College of Pharmacists. (s. 75 of Act 17-04 on the code of the medicine and pharmacy)

The property owned pharmaceutical industry can be a company of Moroccan law and behave as a responsible pharmacist and in the form it takes, or a director general, is one of the managers. The technical directors and marketing managers engaged in pharmaceutical industrial establishments should be certified pharmacists. The definition of their technical functions is fixed by the administration after consulting the National Council of the Order of Pharmacists. (Article 85)
